Thank you for your interest in using the Internet-based services provided by Mascus via the website www.mascus.com or any other Mascus operated domains (below together called "Internet Service"). By using and/or registering into the Internet Service you agree to comply with the terms set forth below. Therefore, we ask that you carefully review the terms. 1. General information on internet service 인터넷 서비스의 일반 정보
Internet Service is an Internet-based public marketplace for users in order to find, buy and sell heavy vehicles and machinery. The internet Service presents an up to date selection of used vehicles and machinery from leading manufacturers and retailers. It is also possible for private sellers to place ads. Internet Service brings together buyers and sellers. 인터넷 서비스는 대형차량과 기계를 찾고, 사고, 판매하기 위해 사용자를 위한 인터넷 기반 공공시장입니다. 인터넷 서비스는 주요 제조업체 및 소매업체로부터 중고 차량 및 기계 선택을 최신으로 보여줍니다. 또한 개인판매자가 광고를 올리는 것도 가능합니다. 인터넷 서비스는 구매자와 판매자를 하나로 모아줍니다.
The purpose of the Internet Service is to publish advertisements of used vehicles and machinery on the Internet. Sales agreement regarding a used vehicle or a used machine offered for sale on the Internet Service ("Object") is always drawn up and entered into between the seller and the buyer directly. Mascus is in no way involved in the transaction or the purchase contract. All details of the Object are provided by the seller. The purpose of the advertisements published in the Internet Service is solely to inform. Although Mascus wishes that sellers who use the Internet Service are careful and act in good faith, Mascus cannot guarantee that the data supplied by sellers is free from errors. Before purchasing an Object that is advertised for sale on the Internet Service, the buyer is obliged to check with the seller all the details that may affect the buyer’s purchase decision. When buying a used item through Internet Service, the buyer should be as careful as if buying a similar item via an ad in a newspaper or otherwise. 인터넷 서비스에 게재된 광고의 목적은 오로지 정보를 제공하는 것입니다. 마스쿠스는 인터넷 서비스를 사용하는 판매자가 신중하고 선의로 행동하기를 권고하지만, 판매자가 제공한 데이터에 오류가 없다는 것은 보장할 수 없습니다. 인터넷 서비스에서 판매용으로 광고되는 대상을 구입하기 전에 구매자는 구매자의 구매 결정에 영향을 미칠 수 있는 모든 세부 사항을 판매자에게 확인해야 합니다. 인터넷 서비스를 통해 중고품을 구입할 때, 구매자는 유사한 물건을 신문 등의 광고를 통해 구입하는 것처럼 신중해야 합니다.
If you decide to get yourself a used vehicle or machine, to use financing or transportation service or any other product on the basis of data published in the Internet Service, your contracting partner is the seller of the product and not Mascus. 인터넷 서비스에 게시된 데이터를 기반으로 중고차나 기계를 구입하거나 금융 서비스, 운송 서비스 혹은 기타 상품을 사용하기로 결정한다면 계약 상대는 마스쿠스가 아닌 상품의 판매자 입니다.
2. To register as a user of the Internet Service 인터넷 서비스 사용자로 등록 방법
If you want to register as a user on Mascus Internet Service, enter the user data requested and agree to comply with the terms and conditions which have been provided to you before registering as a user (through the hyperlink). Mascus stores the information you provided, which means you do not need to enter them again when you use the Internet Service the next time. By accepting the terms of the Internet Service, you certify that the information you have provided is correct and agree to without delay notify Mascus by e-mail if your details change. Mascus reserves the right to refuse registration without giving any reason. Mascus may terminate your user rights if the information provided is insufficient or incorrect or if you have neglected to notify changes. Mascus can also deny you the right to use the Internet Service and cancel your account if you act against the terms and conditions. To use the Internet Service, you need a username and password that must be kept safe from access for unauthorized persons. As a user of the Internet Service, you must immediately notify Mascus by e-mail if a third party has gained access to your user name or password. Until the message is received, you are responsible for the use of the Internet Service with your username and password, although the use would be unauthorized by you. 인터넷 서비스를 사용하려면 비권한자의 접속으로부터 안전하게 보호하는 사용자명과 패스워드가 필요합니다. 인터넷 서비스 사용자로서, 타인이 고객님의 사용자명이나 패스워드로 접속했을 경우 즉시 마스쿠스에 이메일로 알려야 합니다. 메시지가 수신될 때까지 고객님의 사용 권한은 제한되지만 사용자명, 패스워드와 함께 인터넷 서비스 사용에 대한 책임은 본인에게 있습니다.
3. Data protection and use of cookies 데이터 보호 및 쿠키 사용
Mascus respects users' privacy and strives with commercially reasonable means to prevent inappropriate use of the personal data provided to the Internet Service. Data collected or provided to Mascus is stored on servers in Europe. Mascus may use and transfer customer information (such as name and e-mail addresses) to third party service providers to perform functions in connection with Mascus’ services. When Mascus uses third party service providers who help Mascus support its business operations, Mascus uses contractual and technological means to require those service providers only to use the information provided to them to deliver Mascus’ products and services – not for their own use. Data can also be transferred to suppliers of accessories, supplementary products and financing services, or to other suppliers of used machinery and services, in accordance with a user’s request for those services. Further information can be found in our Privacy Policy which includes information about the use of cookies by Mascus. 4. To publish an advertisement 광고 게재 방법
An ad that you post or send to Mascus is interpreted as a request to have the advertisement published on the Internet Service. It is the seller's responsibility to specify in which category of the site each advertisement must be published; on Mascus website listings, on Mascus Plus (seller's own used machines listing on its own website) and/or the seller's own intranet/extranet service. 마스쿠스에 게시하거나 보내는 광고는 인터넷 서비스에 광고를 게재해 달라는 요청으로 해석됩니다. 마스쿠스 웹사이트 목록, 마스쿠스 플러스(판매자 본인의 웹사이트에 등재된 중고 기계) 및/또는 판매자 본인 인트라넷/엑스트라넷 서비스와 같이 각각의 광고를 게재해야 하는 사이트 카테고리를 지정하는 것은 판매자 책임입니다.
The user of the Internet Service is responsible for making sure that it has acquired necessary rights and permissions to the content produced by it to the Internet Service. The content produced by it should not infringe any intellectual property rights or other rights of any other person or entity and should not contain statements or material the publication of which may give rise to liability to damages or liability for Mascus. If an advertisement for some reason is not suitable for publication, Mascus will contact the seller via email. Mascus reserves the right to remove the content immediately without further notice to the seller and to terminate the usage rights of a seller or buyer that, according to Mascus assessment, is using the Internet Service improperly or in a way contrary to good manners. An advertisement may only apply to one Object (used vehicle or a used machine). 광고는 하나의 대상(중고 차량 또는 중고 기계)에만 적용될 수 있습니다.
It is the seller´s responsibility to ensure that the advertisement contains the correct product data that provides sufficient information about the Object, its condition and other factors that are important in view of a buyer in compliance with laws, government regulations and good merchant manners. You agree to comply with the information on price and warranty and other information you provide in your ad. It is your responsibility to notify Mascus if the advertised Object has been sold, so your ad can be removed. 판매자의 책임은 광고가 법률, 정부 규정 및 좋은 무역 매너에 따라 구매자의 관점에서 중요한 대상, 그 상태 및 기타 요소에 대한 충분한 정보를 제공하는 올바른 제품 데이터를 포함하도록 하는 것입니다. 광고에서 제공하는 가격과 보증 및 기타 정보에 대한 정보를 준수하기로 동의합니다. 광고된 대상이 판매된 경우 마스쿠스에 알리는 것이 본인의 책임이기 때문에 광고를 제거할 수 있습니다.
Mascus has the right to edit, classify, and copy all or part of the material you have entered into the Internet Service and use it freely in its business. 마스쿠스는 인터넷 서비스에 입력한 자료의 전부 또는 일부를 편집, 분류 및 복사하여 비즈니스상에서 자유롭게 사용할 수 있는 권리를 가지고 있습니다.
Mascus is not able to check whether the information supplied by the users is correct. Therefore, the informant is fully liable for any costs and damages incurred due to incorrect information given to Mascus. It is possible to suspend the publication of an advertisement at any time. Advertisement fee will not be charged if the advertisement is cancelled before it is published. 마스쿠스는 사용자가 제공한 정보가 올바른지 확인할 수 없습니다. 따라서 정보 제공자는 마스쿠스에 제공한 잘못된 정보로 인해 발생된 비용과 손해에 대해 완전히 책임져야 합니다. 광고 등록을 언제든지 중단할 수 있습니다. 광고가 등록되기 전에 취소하면 광고 수수료가 부과되지 않습니다.
Due to Mascus intervals to index data and safety measures, the contents of paid advertisements are not immediately visible on Mascus Internet Service. Indexing intervals can vary depending on server load. Ads from Mascus invoice customers are usually visible on the Internet within hours. To ensure the safety of our customers and visitors, private advertisements are checked for fraudulent, deceptive or unlawful content. Mascus is required to return the advertisement fee if Mascus fails to publish an approved advertisement. The compensation for an unpublished advertisement is limited in all cases to the paid advertisement fee. Advertisement fee does not need to be returned if the advertisement has not been published because of factors beyond Mascus control or for reasons which Mascus could not reasonably foresee or prevent. 마스쿠스가 승인된 광고의 등록을 실패한다면 광고비는 환불됩니다. 미등록 광고에 대한 배상은 모든 유료 광고에 한해 제한됩니다. 마스쿠스의 관리가 아닌 요소거나 마스쿠스가 합리적으로 예측, 예방할 수 없는 이유로 광고가 등록되지 않은 경우엔 광고비를 돌려받을 수 없습니다.
5. Charges and Billing 요금 및 청구
It's free to register as a user of the Internet Service, to read the ads, contact sellers and to publish inquiries. 인터넷 서비스 이용자로 등록해 광고를 보고, 판매자와 연락하고, 문의사항을 보낼 수 있습니다.
The publication of individual ads on Internet Service is a chargeable service. The fees charged for the published advertisements are set according to the current price list. VAT will be added to all prices on Mascus price list. 인터넷 서비스에 개인 광고 등록은 유료 서비스입니다. 광고 등록에 대한 요금은 최신 가격표로 설정되어 있습니다. 마스쿠스 가격표의 모든 금액에 부가가치세가 추가됩니다.
Publication of an advertisement that is sent to the Internet Service is always conditional upon that the fee is paid for the advertisement. Advertisements are paid either by using online banking, giro, bank transfer or by credit card. On the Mascus start pages there are links to the online banking to be used for payment. No advertisement will be published before it is fully paid. Contract customers who market their used vehicles and machinery on a regular monthly basis, get invoices according to price list or customer agreement. 인터넷 서비스에 보내지는 광고 등록은 항상 광고료를 지불하는 것을 조건으로 합니다. 광고는 온라인 뱅킹, 지로, 은행 이체 또는 신용카드로 결제됩니다. 마스쿠스 시작 페이지에는 결제에 사용될 온라인 뱅킹 링크가 있습니다. 광고가 완전히 결제되기 전까진 등록되지 않습니다. 중고 차량과 기계를 매달 정기적으로 판매하는 고객과 계약하고 가격표나 고객 합의에 따라 인보이스를 받습니다.
6. Information on advertised vehicles and machinery 광고된 차량 및 기계에 대한 정보
Mascus wants to emphasize to the user that the data on the used vehicles and machines on the Internet Service comes from the sellers. The data on the Object´s estimated condition is based on a subjective assessment by the seller, and is the seller's own perception of the Object's condition. 마스쿠스는 인터넷 서비스의 중고 차량 및 기계에 대한 데이터가 판매자로부터 나온다는 것을 사용자에게 강조하고 싶습니다. 대상의 예상 조건에 대한 데이터는 판매자의 주관적인 평가를 기반으로하며 대상의 상태에 대한 판매자 본인의 인식입니다.
The data on the used vehicle's/machine´s condition is thus not based on an evaluation conducted by an independent and neutral observer. Mascus is not responsible for the correctness of such information. 따라서 중고 차량/기계의 상태에 대한 데이터는 독립적이고 중립적인 관찰자가 수행한 평가에 근거하지 않습니다. 마스쿠스는 이러한 정보의 정확성에 책임지지 않습니다.
7. Intellectual Property Rights 지적재산권
The user acknowledges that all intellectual property rights with respect to the web sites, the domains, the sub domains, the design, the text, the content, the images, the logo, the trademark Mascus, the software and program material and other material contained in the Internet Service belongs to Mascus, with the exception of the content of the ads, and the user hereby explicitly waives any rights in respect of such intellectual property. 8. Compensation for damages and limitation of liability 손해배상 및 책임제한
Mascus does not warrant that the Internet Service will operate error-free or that the Internet Service and its servers are free from computer viruses or other harmful mechanisms. Mascus cannot be held liable for any damage resulting from errors, computer viruses or other harmful mechanisms. If the use of the Internet Service results in the need for servicing or replacing equipment or data, Mascus is not responsible for these costs. Internet Service is delivered "as is" and Mascus is not responsible for any damages caused by the use of the Internet Service or the malfunction or failure of the Internet Service. 마스쿠스는 인터넷 서비스가 오류없이 작동하거나 인터넷 서비스와 서버가 컴퓨터 바이러스 또는 기타 유해한 메커니즘으로부터 벗어났음을 보장하지 않습니다. 마스쿠스는 오류, 컴퓨터 바이러스 또는 기타 유해한 메커니즘으로 인한 손해에 대해 책임지지 않습니다. 인터넷 서비스 사용으로 인해 기기 또는 데이터를 서비스 받거나 교체해야 할 경우 마스쿠스는 비용적인 부분을 책임지지 않습니다. 인터넷 서비스는 "있는 그대로" 전송되며 마스쿠스는 인터넷 서비스 사용이나 인터넷 서비스의 고장 또는 정지로 인한 손해에 대해 책임지지 않습니다.
If there is an error caused by Mascus in the case of fee-based services, Mascus can choose either to correct the error or return the advertisement fee to the user. The amount of compensation is at most equal to the amount of the ad fee that the user has paid for Mascus for use of the Internet Service. Mascus is not responsible for damage caused by user or third party or damage that Mascus could not reasonably have foreseen. 요금 기반 서비스의 경우 마스쿠스에 원인이 있는 오류가 생겼을 때, 마스쿠스는 오류를 수정하거나 사용자에게 광고료를 환불할 수 있습니다. 보상금은 사용자가 인터넷 서비스 사용을 위해 마스쿠스에 지불한 광고료의 금액과 거의 같습니다. 마스쿠스는 사용자 또는 제 3자에 의한 손해 또는 마스쿠스가 합리적으로 예상할 수 없었던 손해에 대한 책임을 지지 않습니다.
On the Internet Service you will find links to Internet sites that are published by external service providers which are independent from Mascus. Although Mascus offers you links to these services, Mascus wants to point out that these services are provided by the relevant service providers and are to be used on terms determined by those suppliers. Mascus is not responsible in any way for the products or services of others. 인터넷 서비스에서 마스쿠스와 독립적인 외부 서비스 제공자가 등록하는 인터넷 사이트 링크를 찾을 수 있습니다. 마스쿠스는 이러한 서비스와의 연결을 제공하지만 마스쿠스는 이러한 서비스가 관련 서비스 제공자에 의해 제공되며 해당 공급자가 결정한 조건으로 사용해야 한다고 지적하고 싶습니다. 마스쿠스는 다른 제품이나 서비스에 대해 어떤 식으로든 책임을 지지 않습니다.
The total liability of Mascus under this agreement shall in all cases be limited to EUR 500, except in cases where the damage has been caused by an intentional act or through gross negligence. 이 계약에 따라 마스쿠스의 총 책임은 고의적인 행동이나 태만으로 인한 손해를 제외하고는 모든 경우 EUR 500으로 제한되어야 합니다.
9. Availability 유용성
Mascus has the right, without notice, in whole or in part, remodel, remove, add or otherwise change the contents of the Internet Service, or its operating times, technical details or other content. Mascus has the right to temporarily suspend delivery of the Internet Service for maintenance or modification of the Internet Service and Mascus cannot be held liable for such suspension, maintenance or modification. 마스쿠스는 공지 없이 전체적으로 또는 부분적으로 인터넷 서비스의 콘텐츠, 운영 시간, 기술 세부 사항 또는 기타 콘텐츠를 개정, 제거, 추가 또는 변경할 권리가 있습니다. 마스쿠스는 인터넷 서비스의 관리 또는 수정을 위해 인터넷 서비스 제공을 일시적으로 중단할 권리가 있으며 마스쿠스는 그러한 중단, 관리 또는 수정에 대한 책임을 질 수 없습니다.
10. Amendment of conditions 조건 수정
The selection and design of the Internet Service is constantly evolving and therefore Mascus reserves the right to change the conditions of its services. At the time of log in the user shall be informed of the amended terms and conditions, or via e-mail. The amendments will become effective after log in or within 30 days after publishment of the amendments on the Internet Service (including through email). If you continue to use the Internet Service after the terms have been changed, you acknowledge that the new terms are binding on you even if you have registered as user prior to the new terms came into force. 인터넷 서비스의 선택과 디자인은 끊임없이 진화하고 있으며 따라서 마스쿠스는 서비스 조건을 변경할 권리를 보유합니다. 로그인시나 이메일을 통해 사용자는 수정된 기간 및 조건을 알립니다. 개정안은 인터넷 서비스(이메일을 통해 포함)에 개정안이 게시된 후 30일 이내 혹은 로그인한 뒤 발효됩니다. 조건이 변경된 후에도 인터넷 서비스를 계속 사용할 때, 사용자로 등록된 경우에도 새로운 조건이 사용자에게 구속력을 부여하고 있음을 확인해야 합니다.
11. Feedback 피드백
If you believe that material in the Internet Service to any part is incorrect or faulty, please notify us by sending information to Mascus from the "feedback" link on the Internet Service´s front page. 12. Nullity of Terms 무효 조건
If any term of these general terms is considered to be invalid, void or unenforceable to any extent, all remaining terms shall remain in full force and effect. 이러한 일반 조건의 어떤 조건이 무효하거나 시행할 수 없는 경우 나머지 모든 조건은 완전한 힘과 효력을 유지해야 합니다.
13. Force majeure 불가항력

14. Validity of terms 유효 기간
These binding conditions will take effect when you accept them by using the Internet Service or by registering as a user on the Internet Service. The conditions are valid for an indefinite period. 15. Early termination 조기 종료

Mascus has the right to use subcontractors in the provision of its services. 마스쿠스는 서비스 제공에 하청업체를 사용할 권리가 있습니다.
17. Settlement of disputes and applicable law 분쟁해결 및 적용법률
Dutch law shall apply to this agreement, excluding its choice of law provisions. Any dispute, controversy or claim arising out of or relating to this agreement, or the breach, termination or validity thereof, shall be finally settled by the Court of Amsterdam, the Netherlands. 본 계약에는 네덜란드 법률이 적용되며, 법률 조항의 선택은 제외됩니다. 본 계약 또는 위반, 해지 또는 유효성과 관련하여 발생하는 모든 분쟁, 논란 또는 주장은 네덜란드 암스테르담 법원에서 최종적으로 해결됩니다.
